Environmentally hazardous products will be certified on a mandatory basis

Government Resolution (№ 75, February 16, 2021) approved the Regulation on the procedure for mandatory environmental certification of environmentally hazardous products and waste for import into the territory of the Republic of Uzbekistan and export from the territory of the state.

According to the Regulation, the import and export of environmentally hazardous products and wastes to Uzbekistan will be conducted on the basis of an environmental certificate issued by an environmental certification body accredited by the State Committee on Ecology and Environmental Protection.

To obtain a certificate, the applicant applies with an application through the customs information system "Single Window" or directly to the environmental certification body in the system of the State Committee on Environment.

Within 1 working day, the environmental certification body analyzes the submitted documents and, if the submitted documents are complete, makes a decision on certification of environmentally hazardous products and waste.

An environmental certificate is provided for the period:

in accordance with a copy of one foreign trade agreement (contract) and an agreement (agreements) concluded between the supplier and the receiving party, which indicate the exact volume (amount) of imported environmentally hazardous products and waste (excluding vehicles) - for a period not exceeding one calendar year;

for each batch of environmentally hazardous products and waste - for a period not exceeding one year;

for batch production processes - for a period of 3 years.

This procedure comes into force on May 1, 2021.

The Decree of the President of the Republic of Uzbekistan from February 18, 2020 № DP-5938 "On measures to improve the social and spiritual atmosphere in society, further support the institution of makhalla, as well as raising the system of work with families and women to a new level" was adopted

The document was developed in order to ensure the well-being of the population, raise the system of working with families and women to a new level, increase the social activity of representatives of the older generation, further strengthen the role and status of citizens' self-government bodies in transforming the makhalla into a crime-free territory, as well as the implementation of tasks.

Mediation process in Uzbekistan

According to the law “On mediation”, mediation is a process of resolving a dispute with the assistance of a mediator on the basis of the voluntary consent of the parties in order to achieve a mutually acceptable solution.

Mediation can be carried out in 3 categories of disputes:
disputes from civil matters, including business disputes;
individual labor disputes;
disputes arising from family relationships.

The activity of a mediator can be carried out on a professional or non-professional basis.

A mediator on a professional basis is a person who got a special training course under the mediators training program approved by the Ministry of Justice of the Republic of Uzbekistan and entered in the Register of Professional Mediators.

A mediator on a non-professional basis is a person who has reached the age of 25 and has given consent to perform the duties of a mediator.

The system of organizing training of specialists abroad will be radically revised

The Decree of the President "On measures to radically improve the system of training abroad and further increase the potential of civil servants and specialists" (№DP-6168, February 11, 2021) was adopted.

In accordance with the Decree, additional tasks and directions of activities of the El-Yurt Umidi Foundation were determined.

According to this, the system of search, selection, organization of training of specialists abroad will be radically revised.

According to this document the next will be developed:

study programs for bachelor's, master's and doctoral studies abroad on the basis of open scholarship competitions are the main educational programs of the Foundation;

Competitive selection of candidates for the educational programs of the Foundation is carried out on an ongoing basis in a form open to all citizens of Uzbekistan, regardless of the place of work and study on the territory of the republic;

The Fund, on the basis of direct orders from ministries, departments and organizations, organizes internship programs in promising and in-demand specialties.

Open competitive selection of candidates for educational programs of the Foundation is conducted in the following areas:

state and public administration;
ensuring the rule of law and the judicial and legal sphere;
education, healthcare and other social sectors;
spheres and branches of the economy.

The Foundation for Teaching Youth under Bachelor's Degree Programs in Developed Foreign Countries, on the basis of open scholarship competitions, will allocate 100 places in 2021, for master's and doctoral studies - on average, 5 times more places in relation to previous years.

According to this the Law of the Republic of Uzbekistan from February 16, 2019 № LRU-520 «On the accession of the Republic of Uzbekistan to the Treaty of the World Intellectual Property Organization on Copyright» was adopted.

The World Intellectual Property Organization Copyright Treaty (WIPO Copyright Treaty or WCT) is an international treaty on copyright law adopted by the member states of the World Intellectual Property Organization (WIPO) in 1996. It provides additional protections for copyright to respond to advances in information technology since the formation of previous copyright treaties before it. The WCT and WIPO Performances and Phonograms Treaty, are together termed WIPO «internet treaties».

The privatization process of state assets will be accelerated

The Presidential Decree “On measures to further accelerate the processes of privatization of state assets” (№ DP-6167, 11.02.2021) was adopted.

In accordance with the Decree, by organizing the processes of allocation to public auction and selling the relevant state assets:

The involvement of professional organizations is conducted by the State Assets Management Agency or the investment company "UzAssets" based on the selection of the best proposals. At the same time, it is not required to conduct an examination of the contracts;

it is allowed in the bidding process to take as a benchmark the value or range of value determined by professional organizations for the purpose of realization of state assets (regardless of the requirements of the national standard for valuation activities);

the requirement for the mandatory establishment of the starting price of state assets of their value, recommended in the appraisal report of the appraisal organization and determined in its expert opinion, is not applied;

The State Commission on Tendering for the Sale of State Property is empowered to make decisions on the publication of announcements on the sale of state assets without announcing the starting price, as well as the sale of state assets based on the best of at least two proposals (regardless of the price recommended in the appraisal report and defined in the expert opinion).

By August 1, 2021, the procedure for selecting appraisal organizations, determining the cost and paying for their services in the privatization of state property, based on the selection of the best commercial proposals, will be implemented.
