Agreement on a plea of guilt in criminal cases included
The President signed the Law "On amendments and additions to the Criminal and Criminal Procedure Codes of the Republic of Uzbekistan" (№ LRU-675, 18.02.2021).
According to the alterations made to the Criminal Procedure Code, the following institutions are being introduced:
● A preliminary fixing of testimony;
● A preliminary hearing in a criminal case;
● Agreement on plea of guilt.
The preliminary consolidation of testimony consists in interrogating a witness and a victim at the stage of pre-trial proceedings at the request of the prosecutor and is carried out by the court.
In cases where there are grounds to believe that a later interrogation of a witness or victim may be impossible due to objective reasons, their testimony may be preliminarily fixed.
A preliminary hearing is held if there are grounds for suspending the criminal proceedings, terminating the criminal proceedings, sending the criminal case to the prosecutor who approved the indictment, indictment, or decision on the application of a compulsory medical measure, as well as excluding inadmissible evidence from the case.
The duration of the preliminary hearing should not exceed 10 days.
Agreement on a plea of guilt - an agreement concluded with a prosecutor on not representing a great public danger, less grave and grave crimes, based on a petition of a suspect or an accused who agreed with the suspicion or accusation brought against him, actively contributed to solving the crime and made amends for the harm caused
According to the amendment made to the Criminal Code, the term or the amount of punishment imposed for crimes for which an agreement on the admission of guilt has been concluded cannot exceed half of the maximum prescribed punishment.
The Law comes into force from the day of its official publication.
